All total BS posturing in my opinion... and did not sway my "NO" vote...
I don’t have any copies but I know for a fact the word “bankruptcy” was NEVER used except in internal (company/ALPA) communications. The IAH based scab contingent was instrumental in ramming through that POS contract.

Joe, at the EWR roadshow the ALPA lawyer said passing the contract wouldn’t guarantee staying out of BK, but not passing C ‘05 would make BK likely. Much as we’d like to put it on IAH scabs, they were far from alone in pushing the contract. It was being pushed by our counsel from ALPAN as well.

I was at that roadshow and I still call BS. If it was so imminent, why was it NEVER mentioned by ANYONE else- especially in the financial community? The previous imminent bankruptcy, when Bethune took over, was splashed all over every newspaper and business magazine for weeks and months.

Without the IAH scab reps and Panarello, this thing would have had a much harder time coming to fruition. Since GUM and CLE, as well as the FI’s, usually voted in lockstep with the IAH scab contingent- it was game over.

Pretty much agree with your assessment, but a potential BK was mentioned by our ALPA-N counsel who, as you probably remember, was pushing the concessions hard.

I believe the National attorney was Ken Cooper. He was buddies with Stivila and they vacationed together too on a cruise during negotiations.

By the way it wasn’t just the scabs. Randy Newman EWR FO rep voted for and was selling that POS too. FYI don’t forget Stivila ave Muir both on NC and both NC Chairmam during that POS contract negotiation cycle. Both picked by Fred to work for him and negotiate against ALPA. Both in flight ops management today and Rick is just below Howard. After POS consessionary contract passed and Ken Cooper’s BS was exposed he retired from ALPA. He was a very weak negotiating attorney.

Jackson Martin did just as much, if not more, damage than those two *****s when he went to work for Abbott too.
