A lot probably hinges on the outcome of the ExpressJet TA vote. I’m surprised that there hasn’t been more chatter about the EMB 175 and change-of-ownership language in the ExpressJet TA:
This Agreement was entered into by the Parties in reliance on certain key business events occurring. Therefore, the Parties agree that the following events alter the duration of this Agreement as follows:
As stated in Letter 1 to this Agreement, United Airlines has guaranteed to award delivery of a minimum of 20 EMB175s to ExpressJet which shall be operated under this Agreement. Deliveries of the aircraft will begin in the second quarter of 2019.
Should United Airlines not award the EMB175s to ExpressJet following ratification of this Agreement, the Parties will immediately re-enter Section 6 negotiations.
If SkyWest Holdings, Inc. is still a majority owner of ExpressJet Airlines at the end of Jan 2019, the Parties will immediately re-enter Section 6 negotiations.”
The end of January is also the amendable date of the United contract; UAL and ALPA have targeted having a new agreement by then. Coincidence?
