How is that a "simple" question when approximately 31/570 reported for work and the Judge defined all 570 as employees as of the date of the strike ...and then another Court reversed that "label" ...and then United said they would terminate them? How can a company terminate someone who isn't employed? Doesn't seem that simple, really.

RAKESTRAW v. UNITED AIRLINES, INC. | Leagle.com

25. On May 17, 1985, at 12:01 a.m., ALPA began a strike against United. Only 25 of the 570 reported for work on May 17, 1985, and approximately six others reported for work a few days thereafter. Stipulation ¶ 10.

AND;

40. On August 15, 1985, Lloyd Barry sent a letter to all pilots hired as replacements during the strike. The letter provided in relevant part:
[W]e recognize that Judge Bua's decision has a profound impact on you. In that ruling, which we will also challenge on appeal, the Judge found that the [570] were in fact employees and were entitled to seniority dates of May 17, 1985. The obvious effect of this ruling, if not overturned on appeal, is to place those [570] pilots on the seniority list as of that date, ahead of the replacement pilots.
The appeal process can be a lengthy one. In the meantime, however, be assured that United will stand behind those pilots to whom it committed permanent replacement positions....

Minor detail that the ALPA pilots agreed to but the United faction can't seem to comply with after almost 30 years:

e. ALPA agreed:
to take extensive active measures to eliminate the residual tension between those pilots who struck and those who worked during the strike, including activities which might constitute reprisals or recriminations as a result of the 1985 ALPA strike (e.g., any worker lists, workplace ostracism or harassment).

wear the pin in support of ALPA.. but don't abide by the agreements ALPA makes? hmmmmmm...........

They applied for, interviewed for, and accepted a job to fly struck work. What would you call them?

You really have no idea what you are talking about, I don't know where you were in 1985 but again you really have no idea.
I can only assume that you had a bad experience with someone from that group, yes this I understand as with every group you will have some.
I also first thought you flew during the strike but seeing the guppy driver bit tells me otherwise.
For you to keep throwing around what most would consider bad information is not helping anything at united, but I don't think my comments will change your mind on anything.

Are we really discussing the 570's and their intention to scab? They didn't and that should be the end of it. This is just another red herring to divert attention away from the pressing issues.

Time draws near to section 6 openers. Are we going to be in agreement on a future contract or squabble revisionist history debates?

Who cares. This pilot group WILL vote "yes" yet again. I guarantee it. I'll be voting "yes" for the first time in my career. I wonder if we will be outsourcing 120 seaters this time. Time will tell.

You definitely don't understand the forces driving the vote on the UPA or, more likely don't want to understand. Continuing to think the merits, or lack thereof drove the vote only discredits you even more.

I don't like how the cal side handled SLI/UPA issue. At least I understand why they did as well as those who voted no.

If you don't think that this current management isn't already planning on frightening a certain group to vote yes...you are more naive then I could ever imagine. Obviously won't be LCAL/LUAL issue. Any guesses? Honestly, I'm not sure what they'll do. We are hiring a crap load of people who don't have the same furlough protection as us. Mention the "f" word to them, you're bound to get some to vote yes. Guys about to retire? Large retirement package? Who knows. But there WILL be something just like last time. Heck, management was so good last time that they got YOU to blame US (and not management) for all the problems on planet earth.
All we can do now is brace ourselves and hope our own personal demographic isn't in managements crosshairs.
