looks like AA/US will not appeal the judges ruling.

Has the Court even ruled? I thought it was just the recommendation of Levie, the Special Master.

How are AMR and LCC supposed to prove in court that they need a merger when they are both making record profits? It seems like after each record breaking quarterly earnings the merger chances diminish a little more...

Just because they are making money does not mean they shouldn't merge. Wait for the next down turn.

This is obvious yes, but in the DOJ's eyes, a big airline making lots of money is bad. For the passenger. Or something.

Because their costs are artificially low due to AMR's restructuring and LCC's still-ongoing merge of East/West.

Everyone knows this (including the court). This is an antitrust case, not a "We can't make money without the merger" case. The latter was already settled in bankruptcy court.
