Best to hope for is that judge approves the deal and let's it continue while the appeal plays out.
The judge already ruled that the "accused" (AA) has a right to a speedy and fair trial, which by the way, is set in law. The Judge has also ruled that any delays can cost AA/LCC additional money and financial burden and thus cause harm to the defendant.

I don't think the DOJ has ever appealed an anti-trust case. I don't see them starting now.
Let's first win the thing before we worry about what would happen if we did.

I'm thinking there will be a settlement at a late hour.
The way I see it the DOJ has an opportunity to look really good with no risk by settling.
If it goes to trial and the DOJ loses, nobody gets any slots. If it goes to trial and the DOJ wins, nobody gets any slots.
No political advantage if no one gets anything from us, very risky and politicians don't like risk!

If this was only about slots I think this would have been settled long ago. The doj has said this isn't just about slots. How will the doj address the other points in their suit if they just settle for slots?

Guarantees to remain in markets? Agree to maintain current fair structure for a specific time? I never said it was ALL about slots.

I think you could be right. Lots of upsides to settling. Ask me how I know about leaving it up to the courts.
