That's how negotiations work. It's how unions and managements negotiate contracts and how you argue in arbitration. You make the "box" as small as possible for the other party that way when you meet in the middle, it's closer to your goal line.

Indeed the process was laid out. It was laid out in a contract called the 2005 Transition Agreement. The courts will enforce that contract until it is nullified on Monday the 9th.
Courts do not enforce arbitration. Never have. Never will. They enforce the contracts that circumscribe the arbitration. The 2005 TA will be no more and no longer enforceable on Monday.

I'm not sure which group it applied to but my understanding was that in the United Continental SLI, guys that flowed up from Continental Express didn't get credit for their time at their express carrier. It's all speculation until we're crying over the final SLI.
