Happens everyday taking off 747-8f at mtow out of LAX to Asia. Often clean speed of 270-287. Normally we tell ATC as courtesy so they can plan, but they are more than used to it.

ATC in their role is representing the administrator. The regulation clearly defines an exception, thus ATC can and does use it.

Good answers here. I'd also add that interpretation of these requirements vary by region of the world. So it's pretty easy to request high speed in some parts of the world, while other places will have you maintain 250 knots regardless. This means in some parts of the world I'm dragging flaps 1 to 10k while other places I'll be clean and 270ish ASAP. People smarter than me can wade into which regions require what, when a reconfiguration of the airplane is required based on interpretations from chief counsel, etc.

No need to request “high speed” if it’s an operational requirement. You can do it as a courtesy, but that’s really all it is.

and no, ATC cannot give you greater than 250 if you just ask for it...

You are incorrect.

Most "heavies" cannot maintain 250kts or less when they are cleaning up after Take Off. Minimum clean maneuvering speed is allowed and a courtesy call to ATC advises them of your situation.

This discussion reminded me.......what speed can a 777 (ER or LR I guess) reach flying SE at MGTOW in the clean config with MCT set in level flight on a standard day at clean up altitude?

I'm guessing 280-300 KIAS, but is it even faster?

Vmo if you don’t modulate your thrust. About 330 kias at sea level. The engines have ridiculous power. When they initially had the auto-rudder feature put in 100% of the required rudder on a V1 cut, there were crews that didn’t know they had lost an engine until they got airborne and cleaned up.

Not to speak for them but I think the insinuation is if it’s not due to operational necessity the ATC can’t authorize exceeding the 250 below 10. In other words a 737 can’t be authorized to go 280 below 10 just because they felt like it. That would imply the ATC has authority to give permission which they do not.
There is no authorization request to exceed 250 when the minimum safe speed is above 250 however. The reg clearly authorizes exceeding the 250 limit without asking. So even if you ask the ATC they will only be only clarifying to you that you are already authorized by the regulating body. They themselves aren’t giving you permission as it was already given.

In America, correct.

Overseas and military, Ive has other experiences.
