We turn it down. They hire foreign pilots, or "cheap" pilots. We take them to court, and the court will rule in their favor, as they offered us something...and we turned it down. This is a very realistic outcome.

Look at the STS experiment with ATLAS. CATHAY had new Captains hired out of seniority in their past...

Our leverage is little or nothing. I'm not in favor of this, but, would rather have something rather than nothing. Keep the flying on our list. No one bid the FDA's. Make them suck up the cost of the STV fully. That cost alone will make them have to re-evaluate this whole thing.

I trust this company as far as I can throw them...and this gives them the excuse they want to break scope...doo doo sandwich either way, it's just that one has cheese.

PS, anyone that has more info on the problems with accepted fares, please post that info, as I've missed what the problem has been.
Or the Judge says: You offered them WHAT? How much did you offer the mid level manager (assumes MEC asks question by then)? Your paying what for his kids school? For his housing?

Judge then rules in our favor and we become a union owned airline. Just as realistic.

Well after reading this thread and listening to the BS in the crew lounge and bus I have to laugh. First was the criticism I've heard toward Chimenti and crew; My take is they got the best deal they felt they could with the level of support they have. Now either vote for or against and show them if they were right or wrong. I doubt they were wrong, because I personally know "good union members" (sic) flying extra during our last contract talks. Thank UPS management for our last contract, every bit of it. You want a better LOA the put up or shut up.

I saw BC today (we passed during our airplane exchange in XXX). I commented that lots of folks seem to be ****ed about the LOA ... He said, "Tell them not to bid it!"

THANKS BOB ... that helps a lot.

here's the deal..breakfast with my source...if it's voted down expect junior manning..no decision has been made yet as far as a SIBA base..highly unlikely though...they do want some increase in seniority in these domiciles and that's why they didn't just put out a bid...they think the LOA is an improvement over the CBA..it is..but still subpar IMHO...they expect all junior guys to vote for it because if they do get junior manned at least they will get the money..later

They can't junior man us unless we vote for the LOA.

No LOA, no junior manning.

Vote NO!

correct me if i am wrong (i have been a LOT of times in the past), but if the company willfully goes against the contract (i.e. scope with foreign wet-lease/pilots), don't we automatically get released into self-help? the "fuel sense", dft, vlt, vacation buyback, no extra, etc., can come into play.

i think we need to stand up for ourselves. (if that's possible with our band of disputed flying bubbas)

A Memphis judge rule in our favor? That must be some good peyote! Ask some of the guys who have been around for some time if they can ever remember a Memphis judge ruling against FedEx, not just against us, but any time.

Pdo & Falconjet,

I am not about to rewrite my diatribe(s) on this from the 'FDA Nightmare for Junior Pilots' thread, but CaptainMark's rumor seems to hint with no LOA they plan on junior manning there and force ALPA to grieve the violation. They will win too, a look at industry arbitrations over the past 7 years will lead you to believe the same. Pdo, the NW mechanics, Mesaba pilots/mechs/FA's, and the Comair pilots/FA's have all tried to go to court to make the argument that such contract breeches should force self-help. They all lost. I'll let more politically inclined peeps discuss why.

Did not say it was realistic, just said it was as realistic as the other scenario.
