FDX Deviation Experts
Guys, I had a trip reschedule and go into substitution (or should I say, prostitution). I was given the worst of the worst trips and I declined sub. My time goes into OTP. Not sure about all of that, but I guess I have the opportunity to pick up trips later with some sort of priority. I heard there is a 125% override for OTP, which I confirmed by the CBA, but then I heard that the company recaptures that money somehow. Not sure I understand half of it..
But, my real question is if the deviation money remains intact. I believe that since the trip was removed from my schedule that I keep the deviation money (much of which has been already spent). Again the CBA seems to back this up. However, every time I think I have read that the contract and have a definitive answer, I am missing something in paragraph 26C.11.ii.a. Anyone have any real experience in this area???

You keep it
If your removed for legality, then you keep the bank. As far as OTP, you are pay protected for two months (meaning they don't deduct the trip from pay you never flew for two months---and any trip you make up with OTP will pay at 125%.

I wouldn't look for the answer, here. Call your travel auditor. And, if you don't like their answer, call our pal, David, in Contract. Enforcement.
Let us know what the real answer is.

I agree with Busboy. If you declined substitution then the bank goes away, because you basically dropped the trip. If you had flown your sub trip, then you would have had the bank from the trip you were sub'd off of. But I'm at a Marriott right now, not a Holiday Inn Express, so don't take my word for it.

I believe section 8.C.2 Deadhead Deviation Banks, applies:
a. A pilot shall have a deviation bank established for each bid period. The value of the deviation bank shall equal the value of the scheduled deadhead tickets for trips flown during the bid period plus the value of any scheduled deadheads for recurrent training. However, if a deadhead trip is changed or canceled by the company, the deadhead bank monies remain intact. A deadhead associated with a carryover trip shall be credited to the deviation bank for the bid period containing the showtime for the deadhead.
Intent: If the pilot does not fly a deadhead trip the deviation bank will be reduced accordingly ,e.g., drop without pay, bump by another line pilot, trip trade, etc.
It looks like unless the trip is taken away by scheds, i.e., not dropped because of substitution refusal, that you may lose the bank money. However, did they offer to bump the other trip? If not, you may have an a arguement. So, our pal David should be your next call. Let us know the answer and the outcome.

I got a notification that said that I was removed from my trip due to "trip rescheduled". I was then given a bunch of crap trips which I declined. I opted for OTP instead of these trips. I had a trip a year or so ago that I took the sub trip and got money for the dev bank. I obviously didn't take the sub trips, which was entirely different from the original trip.
It seems to me that this section still applies:

Good question and I do not think the CBA is very clear, please let us know what you find out.
