I am talking about both cases out there right now. You can't say we are not defending members in Good standing if you don't see eye to eye with someone. You have a legal responsibility to represent any member regardless of what your personal feelings are and can't simply say we are now turning your case over to an outside law firm. We will get sued we will lose and pay dearly. Huge Misstep in my opinion.
I can think of a specific example, where a firefighter, who worked for a big city department, and was a member of a union (IAFF), was refused representation in a disciplinary hearing due to aggregious conduct.
In this case, he was alleged (and criminally charged) with shooting his 2 dogs in the head, and dumping the bodies in the trash dumpster behind the firehouse. His reason for doing so was that he was going on vacation, and did not want to pay for boarding his pets.
Of course this made the local news. The union publically said they would not represent or defend him in his job termination hearing.
So my guess is that there are exceptions, where a union does not have to represent you.
Anyone can file a lawsuit for any reason. Whether it has merit, and is successful, is another thing entirely.
