"Come work at Compass, where you too can have your vacation taken from you! " Yeah, that'll draw them in. I know of one guy who is getting married over his scheduled vacation later this year. Venue booked, photographer contract signed, invites sent, honeymoon booked, etc. Think he's going to work over that? Hah!

Trans States has the perfect solution.... threaten section 19 or offer him the option of placing his two week notice.

People love this sort of treatment. It's the best recruitment strategy I've ever heard of.

Contract says: Unless the Pilot consents, he will not be junior assigned,
scheduled, or rescheduled to Fly or Deadhead, on any
vacation day or any of the contiguously originally scheduled
day(s) off, including an Attached Day Off.


However, it goes on to say:

G. Vacation Postponement
1. If the Company operations necessitate the postponement of
vacations, the Company will first solicit volunteers for such
postponement in Seniority order. If there are insufficient
volunteers for such postponement, the Company will
postpone a Pilot’s vacation in inverse Seniority order. When
possible, the Company will provide notice of postponement
at least thirty (30) days prior to the start of the vacation, but
in no case will the Company give fewer than fifteen (15)
days notice of the vacation postponement. A Pilot may not
have more than one (1) vacation period postponed in any
calendar year. Postponed vacations will, at Pilot option:
a. be rescheduled as soon as possible at a mutually
agreeable time;
b. be carried over to the following year and scheduled at
a mutually agreeable time, and the Company may not
again postpone the vacation; or
c. be paid for the cancelled vacation in lieu thereof.
2. If a Pilot has consecutive weeks of vacation and any one of
the weeks is postponed, the Pilot may elect to have the
other week(s) postponed and rescheduled in accordance
with G.1.
3. A Pilot whose vacation is postponed will be paid at 150% of
his hourly rate for any duties assigned or awarded during
the period over which the vacation was scheduled.
Section 7 – Vacation
7-7
4. A Pilot whose vacation is involuntarily postponed at the
request of the Company will be reimbursed for any nonrefundable
deposits, which cannot be reapplied to another
mutually agreeable date, made in reliance on their awarded
schedules. The Pilot must notify the Company in a timely
manner that postponement of a scheduled vacation will
result in a forfeiture of a deposit. Prior to requesting
reimbursement, the Pilot will make his best efforts to obtain
a refund of the deposit but if he is unsuccessful, the
Company will reimburse the Pilot within thirty (30) days of
submitting documentation of the forfeited deposit. However,
prior to reimbursing the Pilot, the Company will be entitled
to attempt recovery of the deposit on behalf of the Pilot. The
Pilot will use his best efforts to assist the Company in the
recovery of the deposit.
5. Except as otherwise provided in this Section 7.G., H.1.b.,
I.1.b. and I.2.b. a Pilot may not carry earned vacation over
to succeeding years without the consent of the Company.
6. Except as otherwise provided herein, the Company shall not
require a Pilot whose vacation is postponed or unused to sell
his vacation.

Wonder if anyone else is threatening to postpone vacations or if coincidentally we were literally the only airline that stopped hiring and now somehow find ourselves in this situation.

Also, keep in mind the vacation postponement clause just says in inverse seniority order. It says nothing about position. Looks like they're going to be forcing first officers to stay before anyone else. If the company was smart they would be running upgrades that can force those FOs to give up they're vacation. If upgrading FOs were smart they'd be trading their vacation before they upgrade.

Hopefully the union can get them commit to staffing numbers in writing before this cluster actually goes down. Otherwise they're simply going to abuse it more than they already are.
