I see what you are saying but if the flight plan had a route within 60 minutes of land, could you deviate or go direct just because you HAD a plan. Seems very open ended. Why not just plan a longer route every time, and encourage fuel saving?

According to AM 3.3.2 enroute deviations outside of the dispatched ETOPS area of operation are permitted for operational safety reasons only. This sentence is in regards to being in ETOPS airpsace under one category (ie: 120-minutes) and then devatiating into ETOPS airpsace of another category (ie: 180 minutes.) Although nothing says we can enter ETOPS airspace on a non-ETOPS flight, I think it's safe to assume we can in light of the AM language.
If I'm on a non-ETOPS flight and need to deviate for weather, I'm going to deviate.

Not to be pedantic* but land has nothing to do with it. It's a distance in still air from an adequate airport.

This is my attitude as well. I'm just wondering what a motivated FAA inspecter or lawyer might think or pursue. I'm specifically talking about non-ETOPS WATRS operations. We don't draw ETOPS circles and we don't even have quick access to dispatch etc.

I don't think the door is unique to the max. In fact I think the Delta 900's have the door and might well be grounded for inspections shortly.
