It's not an express or implied contractual provision. It's a company policy set forth in the FOM. The contract, besides book ending ASAP and FOQA with deidentification policies, has nothing to do with standard operating procedure, express or implied.
And yes; there's a difference between the two. However they're addressed differently in terms of the grievance process.
