Seniority List Condition #3 reads as follows:
Neither the implementation of the ISSL (integrated single seniority list) nor the implementation or expiration of a condition or restriction herein, in and of itself, shall cause the displacement of any pilot from his or her then-current position (including pilots who have been awarded positions but had not commenced or completed training).
Many former DAL pilots were mandatory displaced from the 767-400 or MD-88 as a result of the movement of flying on those aircraft types to former NWA bases. Many of those pilots had indicated a willingness to follow those aircraft to the new bases and in fact bid those positions, but were unable to hold those positions as a result of more senior former NWA pilots bidding that equipment and base.
Therefore, implementation of the ISSL, in and of itself, has caused the displacement of those pilots from their then current position in direct violation of Condition #3.
Definitions from the JCBA:
Category = the combination of a pilot's position and base.
Position = the combination of a pilot's aircraft type, status, and classification as domestic or intl.
Status = a pilot's rank as Captain, First Officer or Second Officer

So what you are saying is that because they moved those jets and they then I got displaced we should file a claim?
If you lost your "position" as a result, then you have a claim. "Position" does not include base.
Lawyers like the "but for" test. Apply it here.
Quite a few guys would have been able to hold their "position", albeit in a new base, "but for" the single seniority list. Therefore C&R #3 was violated.
Ipso facto. Presto chango.
What the heck. If the NWA Merger dudes forced an expensive arbitration by saying that 777s that were already on property are replacement jets for 747s that haven't even left the property, then this claim has at least that much merit.
Two can play that game.
And I'm just getting started. Give me a couple days to dream up some more. I'll claim that my claim is a claim, in and of itself, and therefore I have a claim. Just like Northwest. The Committee will deadlock. Just like Northwest.

The 767-400 or the MD-88 are not fenced, neither is the A330, which a lot of DAL-S bid into.
All I'm saying is that no claim can be filed on the 765 or the MD88 based on the award, the claim as it currently stands may be a waste of time if we end up getting more 747's out of the JAL deal.
The ninjas at the fNWA are hurting and looking for a fight, some of these guys were DC-10 and 747 Captains at age 36-40 and out of seniority because of the Roberts award.
Regardless of the fences, less flying on the 747 and the 777 affect every pilot on the property, JAL aside, there are no plans to get more 747's or 777's in the near future.
Don't take the claim personal, this guys have been fighting for years to keep something that was never theirs without Roberts.
Educated me on this Check. I mean it. I see it like 330, the positions are not fenced. I agree it does not say that. Just want to see your angle on this.

#3 says no pilot shall be displaced from his position as a result of the single list.
I agree they are not fenced. NWA guys are free to bid those aircraft, and DAL guys are free to bid the 330, but they have to get them as a result of a vacancy, they can't use a displacement. That's what #3 says, is it not?
Is there at least an argument? Then let's arbitrate!!

But that's not true. The DRC deadlocked. So its the guys on the committee as well who voted to send the 777 thing to arbitration and start burning our million buck assessment. Are the NWA committee members ninjas?
