Default DPE's are different

Careful careful...

DPE's are specifically protected by FAR's (not just case laws):
§ 61.47 Status of an examiner who is authorized by the Administrator to conduct practical tests.
(b) The examiner is NOT the pilot in command of the aircraft during the practical test unless the examiner agrees to act in that capacity...

CFI, however, is the PIC depending on the flight/training being conducted.
Think: primary student; multi candidate; training a certificated helo brethren working toward a fixed-wing ticket...

On the 175 there isn't really any brake cycling to extend times. The moment you set the brake the FAs disarm the slides. Once the slides are disarmed, you get an in time.

Sure thing. I know exactly how the system work on the E175. Ive heard stories from CA's about other aircrafts. i.e 145, CRJ's etc.on how the in time works.

Can someone post the language from whatever contract/policies pertain to this?

Is it a strict 'no', or might the CP allow it on a case-by-case basis?
