No, they likely had few assets when married that long ago. A prenup protects assets you have going into the marriage. Assets earned and acquired after a marriage will be divided according to the respective states laws. Had I asked for a prenup before getting married the conversation with the attorney would have been interesting. “Let me get this straight, you want me to draft a prenup to protect your 1968 Capri valued at 300.00 and your collection of Eagles T-shirt’s”?

What a rip. Say what you want but she didnt earn it. He earned it. She made the choice to not work. Not saying she deserves nothing but the concept she was slugging away at an actual job for 30 yrs is a joke. There is a reason nursing homes are full of old women and not old men, the men die sooner because they are getting out of bed at o dark thirty and putting up with the stresses of a job. Stay at home wifes? Not so much.

A prenup (or post nup) can address division of assets acquired during the course of a marriage.

A postnuptial agreement is a written agreement executed after a couple gets married, or have entered a civil union, to settle the couple's affairs and assets in the event of a separation or divorce. It may be "notarized" or acknowledged and may be the subject of the statute of frauds.
