not so sure this time. This administration is hell bent on testing the M&A courts lately and is perfectly fine with repeatedly losing.


Nothing would surprise me though.

I'd agree with this except for the fact they got a pro business, Trump appointed judge. The DOJ was not happy. I don't think the government has much of a shot with this and they'll settle and tout the concessions JB gave to make air travel "more affordable" for everyone. Grasping defeat from the jaws of victory.

I believe it was a Reagan appointed judge. Less tweets and probably has to go **** 4 times an hour. Same result most likely.

Why settle and give up anything if they’re so convinced that it’ll pass muster with the judge? This isn’t B6ALPA is it?

Valid reasons to settle would be, IMO (in no order)
- merger gets completed faster, saving money
- DOT agrees to the certificate transfer
- garner favor with the government and the public by giving them a token victory that isn’t really a victory at all, but something they can sell as a win
- ensuring a victory. Even with a favorable judge, you never know
