There… I just improved our chances in the SLI. Someone’s going to read that and decide Spirit deserves to get stapled at best.
All that matters is what’s on the property the day the merger CLOSES. That’s the ALPA standard. Since both airlines are NB airlines, this SLI will be a piece of cake. Pretty much relative seniority down the line (minor adjustment for longevity) with no fences. Way easier than the AS/VX merger, which was an easy merger.

They don’t need to merge certificates. Look at swa/at. It’ll become an asset acquisition through a holding company aka Guadalupe holdings. Jb doesn’t need 2 certificates to run one airline. This is all mayor Pete buffoonery. He’s getting slammed in the media for being a slacker, so now he has a better sound bite.

Bingo. I don’t think the NK operating certificate brings anything unique (route authorities, areas of operation, etc) that JB doesn’t have or couldn’t acquire separately.

Even if there were two certificates, mayor Pete doesn’t have the legal authority to de facto deny a merger that has been ruled on by a court. I know we are all used to weaponized government by now but he’s a clown.

Agreed. While it's a lengthy ordeal nowhere in the guidance does it say 'if your Administration doesn't like it you can block it at the DOT/FAA level.' A merger transition is spelled out in the guidance. For the nerds out there who wanna read up on it. 8900.1, V3, C34, S1.

Unfortunately, he does. However it would go to the courts and the Supreme Court has been waiting for a case like this to unravel a couple other cases that I can’t remember off the top of my head. They would lose that fight.

What they are going after is the Chevron deferral doctrine since they want to rein in alphabet agencies deciding major issues without specific congressional guidance. Like a seasonal stream or mud puddle being a “navigable water.” They have decades of alphabet agency over reach they’d like to roll back.
