Moak's quote was that those passengers had to be on MEH code, not DAL.

ASA's MEC looked at stepping outside the RLA and just filing suit in Fulton St. Ct. to get management to resolve their grievances as a pure contract law matter.

Correct, but I have not seen that anywhere. I am looking for the code share contract in the SEC library, but I have not been able to find it.

I agree...maybe its time to cut the head off the snake (here at DALPA)!

Hundreds (if not thousands) of DL flights are going to be carrying the YX code, if I understand this correctly, so how is this any differen't than if YX flights carried the DL code on aircraft that exceed scope? And those aircraft could be operated by Skywest or Repubic carrying a YX code as long as there is at least one Midwest airplane still flying to maintain the certificate.

The point that the LEC was stating was that it was a one way code share. Not a two way code share. Their people can travel on DAL flights buying a YX ticket, but our people cannot travel on a YX flight buying the ticket under the DL code. (Make sense)

I am still trying to get the actual contract language for this code share. Something smells to me.
