Well, I went through your closing (abet quickly) and I don’t see anywhere that you guys describe us as being dishonest. There are a few choice words – wrong headed (p27), flawed assumptions (p32) faulty assumptions (p34). They did describe Tom Dolloway as “less than credible” and that he had a “mischaracterization of delta scheduling provisions (p38).

There is a big discussion on the differences of the snap shot used. We used 1 Jan 2008 and you guys used 1 July 2008. My instinct would have been to use the latest available (that military thinking thing) but we talk about it too in our closing. We may differ in whether the justification makes since but at least both sides are presented.

It was hard reading your closing. I felt pretty beat up reading it so I don’t think you guys are worried that we are getting away with anything that they haven’t caught. On a personal note, I liked your closing (more case law cited) than ours, but I haven’t read all of ours yet.

I agree with the other thread………let’s wait for the smoke to clear after the 8th (or sooner?) and see what Santa Bloch brings. Peace?

Why use 1 Jan 2008? How about DCC date or as a compromise, 1 Jul 2008... oh wait, thats what we proposed.
