Default Part 135 Takeoff Performance Question

For a 135 ops cargo jet, does it still need to comply with the Net Takeoff Flight Path? Meaning does it need to comply with at V1 assuming engine failure, clear obstacle of 35ft and continue to climb to 400ft accelerate and climb to 1500ft? Under Part 25, a transport category aircraft falls in this category. And since Transport Category is defined as anything over 12,500lbs, turbojet, or turbojet requires 2 crew members.

I say yes it does need to comply while someone else I know says it doesn't.

What would you say?

Would you NO want to -

at V1 assuming engine failure, clear obstacle of 35ft and continue to climb to 400ft accelerate and climb to 1500ft?

Do you real want to settle for less performance?

I guess what im saying is we are suppose to follow these rules, a friend of mine says no since we dont carry passengers. But i disagree because of FAR part 25 we fall under transport category aircraft irregardless of pax or not.

Milk Man read 135 Subpart I. Its all there. Transport Category Turbine Engine is what matters not whether there are boxes or people.

135.379 specifically...Part 25 Subpart B provides certification requirements for the manufacturer to come up with the performance data in your AFM. It doesn't address the type of operation you are doing.

No where in SubPart I does it provide relief for Cargo vs. Passenger. Ask him to show you where it states that.

If its a part 25 certified aircraft its required - even if below 12,500 lbs. Citation I comes to mind.
