Default Cancelling IFR 135

Under part 135 is it legal to cancel an IFR flight plan at a non controlled airport with the field in sight and VFR conditions?

Yes. Our op specs have some night limitations, but other than that I can cancel whenever I want.

OPS SPECS allow it but you need to be in compliance with 135.79. If you cancel IFR solely by using the applicable ops spec, you may not be in compliance with 135.79(a). If you cancel an active flight plan then your company will ned to have established procedures as stated in 135.79(a). Same goes for departing without an active flight plan and picking it up within 50 miles in accordance with the ops spec. A regulation always trumps an ops spec.

We used to file both VFR and IFR flight plans to comply with this one. You would activate both and when you cancelled IFR, you would still be under a VFR flight plan to comply with this reg.
