Besides, mergers do not have to be mutually agreed upon...ie hostile takeover.

I don't know about that, you can expect branded to be dumped asap followed by the delta pro-rate with jets deal, as both are the reason xjt is bleeding so much cash. They would probably get rid of about 40 airplanes when all is said and done and you know what that means.
The XJT's scope clause.

From the letter he said this
This proposal is also conditioned upon ExpressJet obtaining a clarification and/or amendment, satisfactory to us, to the collective bargaining agreement (the “CBA”) between ExpressJet Airlines, Inc. and the pilots in the service of ExpressJet Airlines, as represented by the Air Line Pilots Association, International (“ALPA”), dated December 1, 2004. First, we need clarification that nothing in the CBA (including, but not limited to, Section 1.D.3) would obligate us to merge the operations of ExpressJet Airlines with those of any or all of our currently-owned airline subsidiaries, or any airline subsidiaries we may acquire in the future, or otherwise apply to us or any of our subsidiaries or affiliates (other than ExpressJet and its subsidiaries). Secondly, we need the agreement of ALPA that the certain undated letter among ExpressJet, XJT Holdings, Inc., ALPA and the ExpressJet MEC, appended as pages 223 through 226 of the CBA, shall be revoked and deemed null and void, prior to the conclusion of the acquisition.

That is what XJT is worried about. We don't want Skywest to use OUR XR options that are convertible to E-Jets and purchase them for the Skywest pilot to fly. I'm not worried about our pay and work rules being tampered with. I'm worried that any and all new flying will always go to the Skywest certificate. Any ASA guys want to chime in? How did it work you ya'll were bought?

That is correct, its been the case that skywest airlines is the only one that is positioned for growth due to our competative costs. I am also sure it will be the case for all future flying. However asa has grown by at least 10 airlplanes in the past 3 years.
But at this point xjt pilots should just be more worried about keeping their jobs and not wanting to grow their airline.
