I don't think that violation of sterile cockpit was the cause of the distraction that led to the loss of control following stick shaker activation. I felt at the time I read the transcript, watched the animation, etc... that there was a failure of proper monitoring of the aircraft flight instruments by the First Officer (PM). Why? A very real possibility was the fatigue/illness that she complained of on more than one occasion during the course of the flight. Why do you think that CJC has been back on it's heels ever since about their sick-call policy. The threat of a job action for calling in sick was real, and a part of the company culture since my first stint here in 04'. According to the emplyee handbook, calling in sick and using your sick time was a "privilege.
Ultimately, we will never know exactly why there was a failure to properly monitor the airplane/flight regime. On the outside it is a failure in basic airmanship, there is no question about that. The real question is why did this failure happen?
Finally, I'd like to add that breakdowns in cockpit decorum/flight discipline and sterile cockpit vilolations are a daily occurance. I've witnessed a major airline Captain having a shouting match with his teenage daughter on his cellphone while sitting on the jumpseat of a 757 taxiing in ORD. So, let's not condemn the "regional" pilot anymore...

Agreed, I was simply pointing out that the F/O had complained of being sick/fatigued and absolutely failed in her primary duty...MONITORING the flying pilot. As for the Captain, it is an unknown what he was thinking, scanning, etc...

The Captain should "remind" him of the sterile cockpit rule which should also be covered in the JS brief. If he refuses to comply, exclude him from cockpit. You have that right as PIC, although it had better be a flagrant violation. Pull the c/b on the CVR and enter it in the maintenance log.

Ain't that the truth. Our old POI had to be reminded multiple times every time he rode up front. Same guy who threatened to violate you if your head wasn't on a swivle at FL250 searching for traffic. And then he had the audacity to say our airline had a "sterile cockpit" issue
