From WSJ:

Mr. Jordan told employees in a message Sunday: “The winter storm was unprecedented all across our network. And we’ve got fallout from that—just trying to get the network back to normal.” Mr. Jordan said out-of-date systems are partly to blame. Part of what we’re suffering is a lack of tools,” he said. The airline had already been in the process of upgrading some of those systems.

Sounds like a genius way to push an already overworked and underappreciated group into 3 days of illness…. And rack up some awesome wrongful termination lawsuits.
Maybe. In some cases RLA (federal) supersedes state/local labor laws, so if the CBA allows it, it might be kosher. Kind of like I'm sure DEN is cool with you toking up on lunch break but FAA/DOT will shred all your certs in a heartbeat.

Blatantly illegal. I can’t believe they didn’t run that memo by a lawyer first.

I'm at another airline....I hate watching this happen to you guys.
Hoping you get better management, mine needs better too.
Too much effort on pronouns not enough on verbs.

From the WSJ, it’s on you iPhone stocks app to read.
”Southwest’s chief commercial officer, said in an interview the airline is taking steps such as covering customers’ reasonable travel costs—including hotels, rental cars and tickets on other airlines, and will be communicating the process for customers to have expenses reimbursed.”

That’d be a nice gesture but will shocked to be contacted.

This is not the case, legally. I'll try to be general with this, and not try to bring in constitutionality.

Look at the recent quagmire regarding work rule requirements in California about having breaks. Held to be legal, constitutional, and binding all the way up the judicial food chain, and is resulting in multiple airlines reconsidering having California bases.

Look also at a lot of California, Colorado, and Illinois requirements for sick leave, harassment training, and parental leave. Also found to be binding for the airline, or at least crews based in that state.

It's about what is more restrictive. Federal law can supersede state law and vice versa, but only in that circumstance. And a CBA can't override/waive state OR federal law, despite what gets ratified and/or signed.

Now if you're upset that "well, this is SWA, and we're supposed to be different!", that I can't help with, other than to say pride goeth before the fall.

In a year no one will remember, or care.
I agree with you that the guy shouldn't base his decision of UAL vs SWA on this once meltdown. But if he has the opportunity to go to UAL and lives in DEN, why on earth would he choose SWA? Seniority loss would be kept to an absolute minimum and he'd have a much higher career potential.

Based on current market conditions….with an offer from both…UAL wins.
