NK is still operating as normal, but APS Is already in contract negotiations.

Because management's argument would be that your "peers" are Sunny, Allegiant, and Breeze. And since the court has already ruled that NK is in a different category than B6, you'd be averaging between an NK losing money and F9 at their current rates.

Not the case at all. Ask a rep what would happen to our pay if we were given a bankrupcy contract. (hint, it will actually go up). Our "peers" are other airbus drivers. Not the company's business model.

True but we are talking about a JCBA not the current state of the airline. Since Spirit isn't making money do they get a discount on fuel?
