While there certainly could be any possible twist in the approach taken by an arbitration board, aircraft not on the property at either airline have never been considered germane by boards in their final decisions. Again, it is who is on both lists, where they sit, and what equipment that is present at the snap shot that develops the hypothetical picture going forward in the "career expectation" evaluation and determination of the SLI.
Case in point . . .

The question is, when is the snapshot taken???
With new merger policy in play, and we are the first, an extended JCBA process delays the SLI. Who knows how long the JCBA will take.
I can throw in all kinds of variables in an extended JCBA process where CAL could argue for a snapshot taken at JCBA signing. For instance, UAL takes advantage of sunset provisions in the merger transition agreement and furloughs more UAL pilots while at the same time accepting new aircraft on the CAL side (okay maybe parking the 500's that remain) and still have a net gain/"hiring" of pilots including UAL furloughs per the agreement.
A can of worms to say the least. How does one approach that scenario? Do you go with information at the date of merger? Has the status quo on the groups changed significantly enough to warrant a new snapshot? Etc.
New merger policy is good IMO, but there is a double edged sword regarding the policy of no SLI process until a contract is signed. If the playing field changes drastically during the course of negotiating a contract, how could one not argue for a new snapshot to be taken if it is in your advantage?

A: There is no single “snapshot” date used during the Seniority List Integration process; rather, there are several that will be used, with each having its own individual purpose.
One date that has already been used is May 17, 2010, which is the date of the Protocol Agreement between the CAL MEC and UAL MEC (available on the Merger Committee web page). That Agreement specified the date for both Merger Committees to initially certify the specifics of each pilot group’s employment data, including the names of all pilots on each seniority list, positions held, and leaves of absence.
There will be additional “snapshots” taken during the Seniority List Integration process to account for additions to or deletions from the respective lists, especially if the integration process continues to arbitration. When we wrote the Protocol Agreement with the UAL Merger Committee, we recognized that a considerable amount of time may be needed to negotiate a Joint Collective Bargaining Agreement, so we included language that requires both Merger Committees to update the lists at a time closer to mediation and/or arbitration.

I hope all furloughs are recalled as soon as possible and, who knows, they may all get recalled before the final snapshot and be back on the property before the arbitrator does the SLI.
