This is now going to a one day binding quick arbitration on 27 Sept. Should know at end of day whether it'll be 4 Oct or 31 Oct.
Big deal? Not huge, but to minimize it is a mistake I think. Company obviously wants to stay on their timeline and show who's boss. They lost one arbitration already, there are two more pending on the 756.
As important I think is the whole process of having to deal with these issues. They just want to put out the edict and have compliance without complaint. That's not happening any longer. Push back on a lot of issues from both CAL and UAL. It's very encouraging.

Union loses
Now for the disappointing news. We learned late this afternoon that the arbitrator ruled against our position on the distributed training. Our CBA very clearly states specific timelines for training events that have qualification implications. Despite our belief that the contractual language was irrefutable and that management’s mandate for Phase 2 training failed to meet those contractual requirements, there is always a risk when a decision is in the hands of a third party. This was one of those times when the risk did not result in an acceptable outcome. We are extremely disappointed and we continue to believe that our case had strong merit. Of course, we will now abide by the bench decision. In its decision, the Board recommended that the Company reset the deadline for Phase 2 CBT to Oct. 6 and issue a clear notification informing pilots to that effect. You are always free to complete training early; however, training completion is required no later than Oct. 6.

O.K. arbitrator rules for the company...so let's take the next leap of logic and hypothetically say that the courts also throw out the subsidiary UAL pilot's lawsuit that was filed yesterday on the topic of safety and training.
First of all if it happens, let me state that I just hope that they are right, that safety is not compromised. This serves however as a perfect example of why the two topics (safety and contract progress) should be separated.
Today's loss feels like an uppercut to the spleen and yet has absolutely nothing to do with any ruling on the pace of negotiations. You can bet however, that some bar in Houston is hosting a few key CAL flight ops people toasting each other over their "big win" over the pilots today. I don't think they are going to get the message with this tack. I want a contract offer. I want that offer to meet or exceed my expectations, or I want to be released to self help.
