Silver noted wryly that since USAPA has already declared it will not participate in the seniority process, she doesn't have to rule on that question.

"Based on the Ninth Circuit's mandate, the Court must enter an injunction prohibiting USAPA from participating in the arbitration unless it advocates the Nicolau Award," Silver wrote. "Given recent developments, that relief appears unnecessary. That is, USAPA has withdrawn from the arbitration and has stated it will make no efforts in the future to become involved. This court is not in the habit of issuing an injunction when there is no longer a live controversy."

Quote: I think you misunderstand the point. I am not saying that there will be only that there is a possibility that there can be. M&B is new and has yet to be tested in court so 3 arbitrators or a 100 is not important. There could be a minor item contained within that a court may find unjust, you just don't know. Either way the train will still pull out of the station on time or at least attempt to.

I think just about every SLI leads to lawsuits. I don't think any have been successful. UA pilots got something through the courts, with the scabs I believe, but that's the only one I can remember.

The courts haven't helped our situation. *IF* the Nic is not used it will be because of a lot of special circumstances ranging from the TA to the merger and MOU.

I'm not generally a betting man, but I'd put a dollar on a lawsuit being filed on this one, but about as successful as any other. I'd like for guys not to waste our time and money. The company and APA seem to have dotted their i's and crossed their t's.

The 570 (new hires that honored the strike)sued to put them back in the original spots in front of scabs basically after the strike was over because the company held them hostage fired them, got jobs back but company put them below the scab stikeberakers in retribution, the 570 lost in court trying to restore rightful place on list. Later during a contract negotiation and some grievances they got the company to move them back to the original positions, scabs filed a lawsuit over that and lost.

United Airlines, now merged with Continental Airlines, has the largest amount of scab pilots working currently for an airline. 2500 plus.
They are the largest group of pilots that belong to ALPA.

You're only off by about 1900 or so.

On a strict date of hire (no idea how many early outs, LTD, etc.) LCAL has right around 450 and LUAL is under 100 as of Aug 1st.

But why bother researching with the facts, its the new way.
