I concede the point in reference to Williams v Jacksonville Terminal, however there is subsequent case law where status quo changes in the absence of a CBA have been successfully challenged despite that decision.

We'll see what the future brings now, but what it will not bring is 5 years or more under that proposed contract.

IMHO, the 5+ years is what scares most if the proposed TA would have passed.

So then what would you say will be the timeline for getting back to the table and re-engaging? And what will your strategy be if the company pushes back and starts sandbagging meetings?

In terms of the case law; how long did it take to resolve those cases? In the case of terminations, who pays the crewmembers paycheck and health insurance; or are they on their own until maybe they get their job back?

Put another way, Plan A always sounds like it's invincible. But the smart money is on the side that has a Plan B, C,and D on the shelf ready to go. I really and sincerely hope that the Omni pilots have them ready to go.

Plan B is that everyone votes with their feet by finding better jobs. Poor business practices are punished, one way or another. In this case, I wonder how they'll staff their jets when everyone gets sucked up to better companies. That's on them to figure out.

One has nothing to do with the other. I'm more concerned over the lack of voter turnout.
