They deemed her unqualified based on the long established standards of requiring 12 years experience to be appointed to the federal bench. They actually did say some complementary things about her outside of that.

I gotta take my old man spectacles and look at the calendar again. Overly extended mask mandate was ending Apr 18. The CDC said to study the new BA v2 variant, they wanted to extend the mask mandate through May 3. Then the Florida judge overturns the mandate. Now the DOJ is trying to overturn the decision. What's the chances of an appeal decision coming before May 3? Since it's probably not, why would the government pursue this if the new extension was ending May 3?
At this point one would have to be an idiot if they really thought the CDC would let it go after May 3. They were going to make up an excuse and extend it again from May 3 to end of May. Then again in June. Then again in July. And again, and again. Probably until the Republican wins in November.
How does ANY of this have to do with science? There is literally NO mandate in the rest of America. People are maskless in homes, schools, offices, concerts, buildings, gatherings, parks, restaurants, indoor stuff, outdoor stuff, everything. So why does putting a mask on for a flight help? They were maskless before the airport and will be maskless leaving the airport. If Covid is gonna spread, it's spreading anyway because there are no more mask protection in the rest of American life. Sorry but this looks like a theater now, nothing more.

People that let their partisan beliefs get in the way were just to blind to see it and felt pompous/righteous to chastise the other side over it.

This is precisely political theater. This ruling which overturned the mask mandate does not prevent anyone from wearing a mask. If you want to wear one, go for it. It simply prevents the government forcing someone to wear a mask. It’s all about power and control.

As the article mentioned, it's not so much about immediately requiring masks again so much as it is about re-establishing the CDC's authority to create enforceable public health policy if/when the future need arises. To that end I almost agree with the appeal, or would have not long ago... The problem is the CDC sh!t the bed with how much it kept pushing its luck out of an abundance of abundance of abundance of abundance of abundance of abundance of abundance of abundance of caution. At a certain point you need to read the room or lose all credibility.

Maybe when there's absolutely zero impact on cases in whatever time it takes to spool up that appeal they'll drop it.
On the other hand, this case isn't really about covid. It's about a government agency's ability to mandate whatever they want on whim without any legislative process. For your safety, of course.

The way I understand it this is not about actually getting us to put the masks back on. This is about establishing the authority of the CDC. Right now they essentially have none and the appeal is about it being on the record that the CDC does in fact have the authority to tell people what to do.
