Wasn't just me. Took three of us to get door open. Fourth guy with a fire extinguisher he had to all but beat the truck driver to hand over the extinguisher to be ready to spray if fire spread beyond engine bay.

Best part was trucking company's insurance lawyer tried to claim if we were able to get her out, we weren't hurt "that bad"

Guy with fire extinguisher had a broken jaw. I had multiple tendon/muscles and a hip that dislocated then went back in.

Classic insurance BS. No wonder people are hesitant to be good Samaritans these days.

I lost an entire year of doing anything fun. No mountain bikes. No motocross. No snowboarding. Was OK enough to work but anything beyond that or real sedate road biking and I was laid up for days. Had to hire movers because there was no way I was moving us. ($23k right there)

I've had 3 surgeries because of the accident (2 minor outpatient, one elbow reconstruction)

I'm going to need a hip replacement but my Orthopedic surgeon Emperor Palpatine is trying to hold off a few more years so I don't have to get it re done in my 70s.

You had a really crappy attorney if all he could get you was a 50K settlement out of all that. My daughter rear ended a woman who said she was fine at the scene. Impact speed was about 20 mph. Insurance ended up giving her 50k in settlement after her claim of neck pain. Neither car was totaled and damage not that bad.

The truck limited out. The initial judgment was much higher. This was reduced to $50k when the judge divided up all our initial awards by what the truck actually had for insurance. Yes, I have a $100k+ outstanding judgment against the no longer in business trucking company. How do you suggest we collect?

The real issue is Delta getting more than anyone else out if the settlement. But you didn't address that.

I'm really curious how DAL can swoop in and do this. Are you DPMP or the HSA?

Any chance of piercing "the corporate veil" of the trucking company for being underinsured and then going after the owners/members directly?

DPMP.

Alpa agrees with my lawyer. It was legal. Just not commonly done.
