Default Heads up international deviators

As a commuter, deviation banks are near and dear to my heart. During contract negotiations, I was very concerned how the whole "lie flat" seat thing was going to affect my deviation bank. I was assured by the NC (and have it in writing) that we would still get the higher fare if applicable, regardless of "lie flat" availability. So I get my first international trip of the year that starts with a DH which has a 1540 block and 1810 duty and thus qualifies for first class. However, the DH was booked in "C" class (business). I call Global Travel to inquire and they tell me that because "lie flat" is available that is the way they were instructed to book it, and I don't qualify for the first class fare. I call CE and they tell me that the Company's interpretation of that section is different than ours. Really? But wait, I was assured...so sorry, too bad, but hey, we are grieving it...Yup, they did it to us again boys!

Thank you very much NC for providing us with such a tightly worded contract with so many great deals! So now, not only do I have to travel a day earlier in order to meet the new 18hr check-in requirement, I have to get there with less deviation monies. Can't wait to see how the rest of contract works out for us...

I'm sure all of the yes voters on here will be happy to pitch in to get your first class ticket. They were so sure of what we were getting with this deal.

So I am confused, what contract language would have made this right? Would you like me to pull it up for you? It says regardless of the class booked we get 1st in the bank. Now if you think I should not trust the contract as written than what should I base my vote on?

Let's Recap:

Contract language says A.

ALPA says language says A.

Company says language says B. Walrus says it is my fault because I didn't know the language says B.

Seems to me that there must be more to this story. The contract is clear, I don't see any way it can be interpreted differently.

The contract says: If a deadhead has 10 or more scheduled block hours, the travel shall be booked in the following order based upon availability of the scheduled flight:
a. First Class (discounted)
b. Business Class (full fare or discounted)
c. First Class (full fare)

Also, if the deadhead is scheduled for more than 16 hours duty, the following shall apply:

a. The flight must be a non-stop flight and blah, blah...

Also, that the deviation bank shall be credited with the Baseline Fare for the highest class of service which is authorized on the scheduled deadhead flight, and which exists on that flight.


So tell me this....is there actually a first class section on your scheduled flight? Because if all there is, is business, then from what I read, is that they would be completely legal to book you business, and that is what your bank will be credited with. Both before the new contract, and after. Otherwise, they need to credit your bank with the first class fare, there is no other way to interpret that. So does the scheduled flight actually offer first class, or is it only business?

No. I wouldn't do that. Because I'm not a dumbass. I don't make a habit of leaping to conclusions without knowing all the facts, and I don't spend my life playing the victim.
