This wouldn’t be the merger of equals it was going to be in 2022.
I’m a spirit guy I tend to agree the F9 Pilots deserve to come out on top.

Being lower on any seniority list is far better than liquidation for the NK guys and gals

Kind of agree with this. I’d prefer a good contract and a strong happy group more than a few extra percentage spots. Frontier is in a much better position than we are. Anyways, big if, if this thing even happens. If it did it would be a Christmas miracle for parts of Spirit. I doubt all of it gets to go to Frontier, which is sad but necessary.

There are really only two outcomes for how a SLI proceeds. One is a pre nuptial agreement. It’s done as a condition of the merger proceeding. Generally however this only happens when management and the pilots at the purchasing airline have a good relationship because it gives the acquiring airlines pilots the ability to veto the merger. Prenups are very rare with the last one probably being SWA and Frontier. No agreement was reached and the merger was cancelled.
The other is managements announce the merger with no conditions on SLI integration. ALPA merger policy Governs the process. A negotiated settlement is attempted and when that fails as it almost always does it proceeds to binding arbitration. The arbitrator is supposed to use ALPA merger policy as a guideline.
  • Career Expectations: Preserving the professional trajectory pilots expected at their pre-merger airline.
  • Longevity: Length of service with the respective airline.
  • Status and Category: Current rank (e.g., Captain vs. First Officer) and aircraft type.
  • Internal Relative Seniority: A pilot's position relative to others at their own original airline cannot be changed.

I think this is the wrong approach. Although I feel for the spirit peeps one thing we have to keep in mind is they are in the second round of bankruptcy. So career expectations for them VS us is vastly different. Hypothetically if this didn’t happen and we didn’t save them no pun intended would they survive? I don’t want to screw anyone over but these things tend to be messy. Look at any merger in history none of the groups were happy. In the end some were a tad more but then they got treated like shizzz because the other guys had a better outcome and that in turn made them hate the other side. I don’t believe any way they dice this will be great. Plus the fact that this isn’t spirits first rodeo with Frankie and I can tell you the guys around from that time do NOT like Frankie at all. I really hope for the best for them but I also really hope I’m not here to deal with it because knowing what I know about indigo it won’t be a good deal for either parties first JCBA. Spirits QOL line items are far superior than F9’s. That will get cut right out and we don’t have the stones in our union to fight for what we deserve.

JCBA is a process to merge the two contracts. There are three parties, the company and both MEC's.

Should start with an agreed transition agreement, basically a roadmap and timeline. This may include some agreement from the company to not do certain things, like shift block hours to the cheaper pilot group.

JCBA is not a normal "section 6" contract negotiation, it may only address parts of the contract that differ. Also the unions can just agree to keep certain sections of whichever is better contract in that regard, vice trying to re-invent the wheel. Especially with two similar NB operators.

Each MEC approves the TA separately, and then the pilots of both groups vote as one block to ratify. This is important because the larger pilot group can out-vote the smaller group, but only if the smaller group's MEC approved the TA to begin with... better trust your NC/MEC.

SLI is between the two MEC's, company is not involved. They can in theory reach a negotiated SLI, but in practice that has never happened, so it will ultimately go to arbitration. With two ALPA carriers, that will be based on ALPA policy, which is more restrictive than the over-arching federal protections.

Hard reality: Furloughs are probably getting stapled. Everybody else will mostly be slotted by longevity... that's not quite the same as DOH, since your longevity for SLI purposes can be reduced if you had furlough time, or even LOA in some cases. If your longevity is reduced, that will only apply for the SLI, it doesn't reduce your payscale, vacay, etc longevity.
