well the be1900 is certified to fl250 only, as is the BE90A&B's...at least the old ones I flew anyways

If the captain is an MEI, and the GW is under 12500, you are appropriately rated, etc...and you are learning from the captain...dual given.

The same is true if the captain is an ATP, even without the MEI, due to the privileges given ATP's under the provisions of 61.167.

E90 is certified up to 31,000

Your FSDO (at least Hillsboro FSDO) won't agree with this statement. If an ATP is not required for the Air Transportation involved, an ATP cannot give instruction. An ATP at United can give instruction in 121, but I cannot give instruction in a King Air 300 even though I am typed and have an ATP. We asked this very question because the copilots that our insurance requires want to log the time as SIC, but are unable to (my instructor ratings are not current).

Also, with the ATP, you can't give instruction in air carriage with pax on board.
