Yeah, they’re paying $787 million because they didn’t do anything and the jury of morons wouldn’t have found anything.

One could quite easily argue that the aggrieved party didn't trust the jury either. Their original damages request was $1.6 billion.
Presumably it was a straightforward civil damages case. The compensatory damages sought would've needed some paperwork to prove.
So the winner in this case was deprived a huge amount, but they took it because juries are a complete gamble. That's a problem.

Damages agreed to of $787 million is just under half of $1.6 billion in the suit. Wish I was the mouse in the corner listening to the thinking. I wonder if they though that they should split the difference, which would be $800 million, minus some little something.

Dominion got half now and the time value of money. Lottery winners make this choice almost every time. It's hard to fault either for cashing that check.

That's precisely what happened. FOX knew they were going to lose. Even more painful, they were also about to watch their on-air personalities, and executives admit, on the stand, they lied to their viewers. They offered up half with the incentive of payment now, vs apeal after appeal and then full payment a decade or more from now.
Dominion got half now and the time value of money. Lottery winners make this choice almost every time. It's hard to fault either for cashing that check.
