DAL 2010 USERRA Letter

Personally, I left because I was tired of being full time. I enjoy my part time gig much better, it really complements being a part-timer in the Guard
.I would call it torture.

It seems almost half of Delta’s new hires are in the guard or reserve. I also doubt anyone interviewing would bring up USERRA.

DAL has gutted my squadron in the last 5 year of hiring. I spent a vast majority of my time at a regional out on MLOA. I was asked about it, but they still hired me. You'll likely be asked if you have any MIL commitments in the following 90-180 days or maybe about any long term mloa from previous jobs. I'd be very surprised if dudes actually walked out of an interview for USERRA questioning. If they did, I'm guessing they either had other offers or their plan was to get their seniority number and bail on MLOA to get their 20. Something about having your cake and eating it too...

Military service members should know that it is DOD intent that one would complete civilian employment training with minimal to no interruption to not overly burden an employer.
Commanders are supposed to know this DOD intent and make accommodations to manage a service member who is starting a new civilian job.
If folks actually walking out, then they should file a formal complaint. They would benefit other military service members. Being asked about previous military duty while at current or previous employers is indicative of discrimination. IMO, HR departments generally pretty sharp to avoid potential legal hazards.
If not legal, file a complaint. Employers are not shy about pressing the edges of the envelope. They generally know the boundaries, however, a service member can be persuaded to disclose more than required by USERRA by subtle requests. Example: It would be helpful if you informed us of upcoming military service (intent: so we can judge your suitability of employment-- illegal). Applicant: Oh, yes, the squadron intends to blah blah. Should say: My intent to is to complete all training required for the job with out interruption and minimize service impact to future employment to maximum extent possible. (and follow through with that statement)

Ya, I should say they asked about it in a roundabout way. So I see you were at X airlines for 2 years but only had XXX (a ridiculously low number) of hours, tell us about that.
I also don't think it's out of line for them to ask if I had any large military obligations in the next X months. I mean they're hiring to do a job, I at least owe them the ability to effectively plan around when to start me and get me through training before I run off to do a one month TDY.

Well it wouldn't make sense for them to place you in a training program when you have to leave on a TDY half way through indoc or sims, would it? I just don't think it's too much to ask that you not have any long term MLOA while you go through indoc/sims/OE. In fact, my unit used to not even let you fly while going through an airline training program until you completed OE. Thought was that the airline would be your money maker long term, so they didn't want you burdened with your mil duty while accomplishing training. We've since relaxed that, but we expect that you'll likely go non-CMR, no big deal for us.
