Yes, which is why I explicitly said "if it is your company's policy".

How much clearer do you expect? I double say "if it is your company's policy!"!

Because your post, #97 seems to indicate that you are still right and the FAR is governing.

If the guy said it's company policy, why are you STILL arguing with him and quoting the FAR as in post 97?

If a jumpseater walks on board in shorts and flip flops and the CA denies him on the plane, even a seat in the back, sorry to break it to you. He's NOT going to have to answer to ANYBODY.

I don't want to argue how this dispatcher's reasoning is wrong, so I will just post this.

Actually his post said "interpretation of the FARs". I never said the FAR is governing, just quoted them so no interpretation was required.

Since this thread has deteriorated into whether a captain has PIC authority until the door is shut I might as well kill this thread entirely...

Gojets.

That is all.

Thanks for all who replied. I suppose when in doubt, I'll talk to the CA.
Wow... you can lead a horse to water...

There is no grey area here.. no doubting the procedure. You owe it to yourself to get this right. It's a long career (if you're lucky?) Why make it harder on yourself and everyone else?

LateralFlyer, it isn't "reasoning", it's reading FARs and Opspecs.

Of course the company is going to listen to a cap if he an issue with a pax, but at the same time, that is not free rein for (nor a right) for captain to do as he wishes, with no questions asked.

Obviously the chief will get involved with any unusual circumstances (and scream "opspecs! ... pilot in command!" all you want).

Who are you trying to kid?
