well in order to use your CFI cert you need your comm cert cause the CFI aint valid w/o the comm so i'd say you are breakin the rules but what they dont know cant hurt them

You are not exercising the privilages of your commercial certificate to be a CFI. This is why you can do it with a 3rd class medical. Flight instruction is the only job you can get paid to do and it not be considered commercial flying. If it was you would be in violation of the limits placed on a commercial certificate. You would be "holding out" which can even be described as "general knowledge you are for hire". Call your local FSDO to ask.

Food for though here for fosters ans saab....... you don't need a medical to flight instruct (to my knowledge) as long as the student has one and is PIC. Not having a medical makes your comm certificate invalid. Your CFI has to be current but that is about it. Also, you can instruct on a 3rd class medical which only give you private pilot privileges not comm. Caution ....... your entering the gray area of the FAA.

To be honest it's one of those rules that could be argued forever. I once called 3 FSDO's and got 3 different answers on what was required for a high altitude endorsement.
Anyway the only way the FAA could allow guys to be CFI's was to make a loophole I think. Most of us are considered independent contractors which would violate commercial rules. As a CFI you can post leaflets or business cards or whatever. As far as the FAA is concerned it doesn't violate any hours. But your regional might have it's own issues. I know a buddy of mine who just got hired on by IFL group for Falcons wasn't allowed to be a CFI during his spare time for a 135 operation. Just part of the company rules.
But 2 guys for Pinnacle and 1 for ExpressJet were CFI's on the side with no issues with the company.
