If this is true, I'll lose all sympathy for those guys.

Maybe they should ban non-pilots from the JS. Don't know about the rest of ya'll but I get real non-talkative below 10K on the JS.

Umm...sterile cockpit. Tell your jumpseater to shut the hell up captain. Weak excuse at best if thats how they want to explain it..

Personally, I've had to shut up two PILOT jumpseaters who were busy discussing waterskiing as we descended below 10K.

So, its not just non-pilots who are a problem.

Feds are not immune from violating the < 10,000' sterile cockpit rule either.

Yes. 121 scheduled domestic/flag require 5 hours (with some caveats to reduce to 3)

Not just jumpseaters... I observed a captain planning his terminal lunch getting strategy and layover plans with the FO on final to a large southeastern hub airport. On the third unanswered call from approach to slow down for spacing I felt the need to speak up.

In all fairness, she (the FO) was easy on the eyes

And that's not an isolated incident. Complacency and human nature. I would wager 99% have at one time or another violated sterile cockpit rules.

The article referenced about the investigation was hack journalism. The NTSB listed that as one of the many factors being investigated. The reporter keyed on it due to a lack of real operational knowledge. (Surely there can't be a non-pilot sitting in the cockpit... That's insane. They just let any guy off the street sit up there). The article could have just as easily, and accurately, used the headline "NTSB: captains lunch could have prompted errant flight".
