Read the PWA, read the LOA's and realize the the PWA states if the FLOW, not up or down being canceled invokes said trigger and the LOA's state that the flow UP can be canceled and the flow down can remain. Two layers of protection there.

CPS and or Mesaba can cancel their flow up per the LOA's, but to cancel the flow down would require all parties to agree to this. So if they cancel the flow up, it does not mean that the flow down is gone. Degraded, yes, but still there.
The PWA states if the flow, and as I read it, that is up or down. So in effect these regionals have control over the 76 seat setback trigger.

Also of note, I have not seen an 8K on from TSH on the acquisition of CPS. So they probably have a condition of sale in the purchase agreement about this flow. The devil is in the detail, and I would assume that there are quite a few in the ASA as well has the purchase agreements of both of these carriers.
There won't be an 8k as TSH is privately held.

I just love chess.

All my attorney's said the same thing. ( all in casual conversation of course )

Another things that is very important legally too is that these LOA's were brought over to the JPWA intact. As I understand it, there are no changes to them. They are referenced in the JPWA, but the actual LOA's came over unmodified. Quite important!
First of all... to pluralize something in English, usually an apostrophe is not required... therefore the plural of lawyer is attorneys. Second.... do you have multiple legal advisors??? On retainer??? NOW I am worried about you.

I've learned to stop correcting people's grammar and spelling on this forum, as iPhone autofill is usually the culprit. It has a tendency to make me look stupider than I am

To be fair, I thought the same thing about the multiple lawyers comment.
I just picked up a out of base Green Slip in DTW. What's a good cheap hotel near the airport where I can buy beer (711 or something).

Thanks

I agree with you and Nu. I hate to see us lose the flow, but in the short run it's probably best. The reason I say this is we will no longer be flowing down to a wholly owned. I have no knowledge of the companies we sold to, I'll let Bar or ACL chime in, but it sure doesn't like any of us would want to work there.

We will NOT park airplanes in the current environment. So, that only leaves rearranging the chairs.

As I said in another thread, I sort of see this as a cake and eat it too opportunity. We get more DCI seats pulled out of the system so they are forced to pick up more lift on our end. The flow up becomes moot as we hire more Compass and Mesaba guys than would have flowed up anyway. As I said before, I'm sure there is a knight moving into position to take my queen but that's how I see this. But, I'm reading all sides because I'm also sure I don't see everything.

Ferd;

I dunno, maybe I'm just not following your line of reasoning.

As almost everyone is tangentially touching on, the DAL MEC has leverage (in about 3-4 different directions) today.

Carl said it simplest - are they going to enforce section 1 or not. Are they really all about "taking every opportunity" What we have here today is a massive opportunity to move the DAL pilots ahead a square or 2 in the cheese store.

Lots of leverage available right now. Call your reps.

Agree. This whole thing as LOTS of layers. Furlough protection, reclaiming flying and, yes, honoring an agreement that WE put in place for the Compass pilots.

We need to know that the MEC has the moxie to squeeze where it hurts until we get what we want. Their record up until now has been meh. Negotiating with an airline is like going to prison. You either need to kick someone's a__, or be someone's b____.

LaQuinta or Mariott Springhill Suites are nice, not too bad. $45 I think. Cheaper is the Days Inn, $38 out the door I think. Up the street is the Wheat & Rye. Huge sandwiches and good beer. Also a Irish, Indian, Chinese place, and Subway w/in walking distance. Just ask the desk where the Wheat & Rye is if you want to go there.

There are a ton of commuter friendly hotels in Romulus right next to the airport. Check priceline.com too.
