Federal Lawsuit Over Status Quo Violations
Yesterday, SWAPA filed a federal lawsuit to stop Southwest Airlines management from continuing their repeated status quo violations against our Pilots and to compel the Company to meet its duty to collectively bargain. To learn more about management’s ongoing breaches of status quo under the RLA.

This action follows SWAPA’s demand letter to Flight Operationson August 11, 2021, in which we sought an end to management’s status quo violations. The Company’s response required SWAPA to take this next step.

Your Union did not take this step lightly, but given the ongoing problems with COVID pulls and management's numerous unilateral decisions that disregarded the Company's obligation to maintain status quo during Section 6 negotiations, this was our only recourse.

We are still hopeful that management will meet and engage in meaningful discussions enabling us to bargain and codify agreements and put an end to this lawsuit. However, until that happens, we must continue to hold them accountable for their actions and take the steps necessary to protect our Pilots and their families.

Spicy. I hope we press onward with informational pickets. Nothing wakes SWA up like people booking away, and John Q. Public doesn't know the difference between an info picket and a strike.

1. That's not what the lawsuit is about
2. Yesterday the company reversed course and announced it will be crediting all sick hours used since June 16 as a result of company mandated quarantine due to work related exposure, the date their policy changed.

So far it's playing out well. Now we just need to read the fine print on the company's reversal.

It’s more that management took a handout and huge pay raises from home in their jammies, then screwed their employees, who were supposed to benefit from the PSP. So far, it’s playing pretty well. I assume SWA management has felt the heat from its employee unions (FA, Pilot, Mechanic) all making bad press, or from their legal team with respect to contract violations.

Not that it'd ever happen (or be allowed to happen), but can't you strike without being released if it's for a status quo violation? Didn't Allegiant try this a few years ago?

Actually it played out really well!

Southwest is retroactively paying pilots for all the Covid exposure pulls they robbed out of people’s sick leave. All due to SWAPA’s lawsuit.

By the inaccuracy, tone deafness, and anti pilot slant of your comment I can only assume you are management?

Yeah we tried it at Allegiant (Teamsters) in 2015. It only lasted a few hours before the company sued, and a judge issued an injunction. Then because we had blown our whole wad and lost all leverage, a little over a year later, we took the crappy contract we currently have with okay money, but no or at least unenforceable work rules.

One star. Do not recommend.
