The fence was a 20 year fence not forever. In addition new widebodies on the property could be bid by republic pilots.

When the fence came down the top 30% in the widebody categories were mostly already republic pilots. They could bid in on new equipment. Since in general Republic pilots were hired at younger ages they went to the top of a category when they were able to jump the fence.

It took the USAir/America West debacle for us to finally conclude that the JCBA should come first in the process. After all, we have far more control over how the contract turns out than the seniority list. Letting fallout over a controversial ISL award poison the JCBA effort was costly and foolish. With current Merger and Fragmentation Policy, at least we leverage a collective bargaining agreement before the arbitrators **** everyone off. But we can still waste time fighting over prospective list construction like our opinions mean something.

Seat position at the time of a merger is irrelevant. Seniority lists are stove piped placing each pilot in the highest paying seat position they can hold. The stove piped list is what the merged list will be produced from. This prevents leap frogging which is a basic tenant of merging lists.
