Default Bump Rights

So the UPA says if 92 days after the effective date you get bump rights if you have not started IOE.

Has anyone experienced this?

What happens? Do you write an email on day 93 to say where you wish to bump to? I assume you finish the IOE and wait to go to training on the bump? What are the training freeze implications?

Is there any clock that's starts for starting the new training on the seat/ equipment you bumped into?

So many questions, so little knowledge

If they haven't finished your OE by the 92nd day, or are not projected to, send this letter to your C/P.


Dear Captain --------,

My name is ¬¬¬¬¬¬¬_______________, FN_____________ ---FO. I was awarded ________, per vacancy award 15---V. I have not had any IOE flights as of the date of this note ----. The effective date of this vacancy award was -- -----. Due to the extensive delay in training and IOE, it is my interpretation that I now have displacement rights. This note is to inform you of my desire to exercise that right. Referencing the UPA, section 8, quoted below...

8-F-9. If a Pilot's vacancy has not been cancelled or activated by the end of ninety-two (92) days (including the effective date specified in the bulletin advertising the vacancy) or three (3) Bid Periods after the vacancy bulletin date, whichever is earlier, the pilot may at his option exercise displacement rights, bid any vacancy, or continue to be pay protected in accordance with section 8.
8-F-9a. A Pilot's displacement rights shall expire if he has not exercised his rights prior to his first segment of IOE.

My displacement bid request is ______________. Please advise what the next course of action must be.

I would also like to request acknowledgement of receipt of this email. Thank you,

Some friends of mine bid to guppy FO from Airbus FO just for the seniority, and with the delay in training, they ended up going to Guppy Captain there. Great for them!

It's kind of amazing to me that they can't get their stuff together on the 737 training fleet. It is the growth fleet and it is a complete CF.

Default Ord Guppy Capt.

Friend of mine got his Guppy Capt. bid in Ord that way. First training date delayed, second one cancelled and on the first minute of the 93rd day he sent his letter in and received his bump bid👍👍✈️✈️😃😄. C ya. Sluggo

777 and 67 as well.

I think that the pre-merger CAL 737 fleet didn't have the 92 day bumping rights, so delaying training was OK. Brining in that part of the LUAL contract kind of surprised management apparently.

With 250+ guppies currently plus the 100 growth guppies being delivered, you'd think they would have planned better.
