Woke up this morning and checked flight aware. Sure enough ATI had multiple departures from CVG this morning.
Not gonna lie, pretty disappointed with you guys. Especially since I have a pic, taken yesterday of 2 ATI pilots hanging at the picket line with us. Guess we'll see who crosses this afternoon at ILN.

ABX pilots may have been removed from CASS, but not Atlas, Southern, or Kalitta. The only pilots that are "on strike" are ABX, the rest are just refusing to cross a legal picket line.

Reading between the lines, it appears that he decided in his telephone conference with the attorneys at 5pm yesterday that he would not grant the application for a temporary restraining order based solely on the affidavits and papers submitted by ABX, and instead scheduled a hearing for today. The TRO procedure in that federal district calls for the court usually first to hold an informal conference with the lawyers/parties to decide what additional proceedings the court wants before it makes a formal ruling on a TRO application. The newspaper article calls today's hearing an "evidentiary hearing", which may or may not be accurate. If it is accurate, it normally means that the court will hear sworn testimony from live witnesses the same way it would at a trial, where each side makes its case by questioning its own witnesses on the stand and the other side gets to object and cross-examine. Perhaps more importantly, it gives the judge the opportunity to question the witnesses himself if he wants to, and to look them in the eye. So instead of trying to make a decision by looking at some affidavit that some lawyer drafted, he can see the major players on the griddle and press them himself for a clear answer to the questions that he thinks are most important. Every judge is different, but a strong, active judge can use a hearing like this to cut through the drivel and get to the bottom of things so he can have confidence in his decision; others will sit back and let the lawyers make the best case they can with their witnesses. Often, an experienced Federal judge who chooses to inquire of certain witnesses will ask much better questions than the lawyers do. Judge Black was once a municipal court judge, so he would have a lot of experience questioning witnesses from the bench.
Okay, this minute entry just came up on the court's electronic docket. It doesn't mention a hearing, but that doesn't mean that the judge didn't schedule one. Specifically, it gives the union an opportunity to file a legal memorandum in opposition to the TRO by noon today:
"Minute Entry and Notation Order: This civil action came on before the Court for an informal preliminary telephone conference pursuant to S.D. Ohio Civ. R. 65.1 on 11/22/16 at 5:00 p.m. Attorneys Daniel Buckley, Andrew McClintock, David Hine, Patricia Griffith, John Doll, Ed Gleason, Julie Ford, Paul Rutter, Lynne Nowel, and Joseph Payne participated. Defendant shall file a memorandum contra to the pending motion for Temporary Restraining Order by 11/23/16 at 12:00 p.m. IT IS SO ORDERED. (Court Reporter Luke Lavin (Official)) (mr) (Entered: 11/23/2016)"
Ten lawyers on the same phone call? Yikes.

Thats because we are getting double volunteer pay to fly to keep our customers.
Plus "our" union the one that matters, has told us this is informational picketing nothing more.
I think this is why we are SO fat on crews. We are way over staffed to the point we could easily double pump the sort with day and night flights out of ILN. Seems like they are calling all the reserve guys in to ILN next week too.
