That would be a valid point if every one of us was being investigated for not being in position for SC. It might be valid if every SC pilot in DTW or NYC was being accused of violating the rules, and told to prove he/she was in position.
But that's not what's happening here. An event caused the company to suspect that a specific group of pilots might have been breaking the rules. The company didn't create the event. It appears they're only investigating pilots who don't have some clear "footprints" that indicate they were in base while on SC. I've spoken with a couple of 744 guys who've commuted to SC dozens of times over the past several months who haven't heard boo from the company. Both of them think it's because they jumpseat in/out of DTW. Your point would be valid if both of them were summoned to prove they'd been in position. Different deal. Sick verification is very specific, and none of those specifics in the PWA require you to be sick, or even have symptoms, when you verify. Also, about half of the disqualifying conditions for airmen are self-determined, so proof of something that can't be detected or measured makes your "prove it!" connection weak. Fortunately, there's the arbitration process. It's a System Board that's not a court of law. It's a professional "neutral" that listens to the facts, the circumstances, and the logic to determine if the rules have been broken. Any pilot with a reasonable response during the investigation such as, "I drove over from Cleveland and stayed at my girlfriend's house for every short call", will then be able to turn the tables: "Prove you called me while on short call and I wasn't available to take the assignment." CAUTION! Using that turnabout might not work if the company has a time-stamped Periscope video of you screaming in delirious ecstasy at a Justin Bieber concert. What if that Justin Bieber Concert was in Ann Arbor or Kalamazoo and they were within 2 hours of DTW while "screaming in Ecstasy"? I agree with the rest though. This isn't a witch hunt. These guys broke the rules in spectacular fashion and are being treated accordingly. This company is very fair with us if we act honorably and do our job safely and efficiently. When we go off the reservation, don't be shocked when the hammer comes down on your head. |
They deserve it. they just pooped their pants in such a spectacular fashion that hopefully we won't all have to wear diapers.
This is the point at which we need to "police" our own and not give the company a (valid) reason to get into our collective business. If you live by the sword you die by the sword. This is of course based on them actually having committed the crime and proven unequivocally |
I agree that it would be unfair to have to retroactively prove you were in place, but there are likely many situations where the company will have you dead to rights. What if the pilots in question were on SC until 0100, they were called at 2300 to fly, and the company has a record of them jump seating out of their assigned base on a 4 hour flight leaving at 2200? DAL doesn't seem like a 1 bad decision company, what if after a pilot missed an assignment the company went back and realized that for the past 10 years they've been cutting out of short call early without getting permission from CS. That would be indisputable evidence documenting systemic abuse of the system. I'm sure there are more situations similar to this one.

The company is not on a witch hunt. They are looking at pilots who have shown a pattern of being out of position or sicking out immediately after being called for a trip. They are not randomly auditing schedules.

I don't believe that the company pulls up each and every SC the "accused" has been assigned over, let's say, the past 36 months and says, "Okay Pilot X....prove to us you were promptly available on each and every one of these days." What I do believe is that the company did its audit and found several/numerous events like the scenario you gave (and, to a more extreme, like the one I posted yesterday) and presents that to the individual. I guess it all boils down to.....if you are on SC, be on short call. If you are sick, call in sick. If your commute has fallen apart, call in honest/unable to commute. However, if you decide to game the system, remember the old adage - "Don't do the crime if you are't willing to do the time." |

This goes back to my post yesterday in response to Gloopy's post. Despite Gloopy's concerns, I can't imagine the company is using that approach in any form or manner with regard to "SC-gate." I think the company sees a high $$$ (Int'l widebody) trip go uncovered after a SC assignment and then the audit begins to see if this was a "one-off" event or if there is a verifiable pattern of SC abuse.
