What scope would be subject to that clause anyway? FM doesn't mean a self imposed unlimited internal Ch.11/1113c process whereby they rewrite the entire CBA as they wish. FM is specific so what applies to scope? Even the furlough pay would most likely be a slam dunk win for us, although its certainlly possible they might roll the dice just to "go for it" as it costs nothing to try.

If there isn't a very specific section of scope that's even subject to FM language, then who would even ask that question and why? Unless it was internally planted for FUD.

I'm guessing the RJ seat restriction if they furlough past Dec. 2006.

I’m guessing he was responding to the furlough pay part of the question

Is that contractually subject to FM?

It did seem that way. However the totality of the question seemed to be a plant with the scope part. I hadn't heard anyone ask that previously, while lots were asking about the furlough pay part (at DL and other airlines). And he didn't refute the scope part (which no one had been asking).

Can't believe he actually said it and can't believe no one has mentioned it.
The next move is figuring out how to shaft pilots who take the VEOP.

I’ll post this here again. It’s an excerpt from the PWA that outlines what force majeur does NOT apply to.

Furlough pay

The FM comments were from a ‘preciously submitted question’. I would be shocked (and disappointed) if they had not worked for hours on crafting the answers to those (and this) question.

I believe it was a question during the live comments. But regardless, they want to use it. And he said he believes that the pandemic qualifies as a situation that they can use it. Unbelievable.
