1B 40E exception two only applies to CPS and remains intact. Read the LOA's and realize that no changes have been made to the PWA.

What this means is:

If the company opts to unilaterally cancel the CPS flow down they invoke 1B40E exception two, which causes the 76 seat aircraft trigger to be executed.
As this agreement states the CPS flow down is in place, all CPS pilots that were on property at the date of sale to TSH will have the right to flow.

The XJ agreement accounts for 12 months of flow ups. After that point the flow is canceled and all other pilots at XJ now fall under the "Preferential Hiring" clause in the DAL PWA.
Of note this was not required by the LOA's for XJ. All that was required was a "Meet and Confer" with all parties. That had been done. The extension of the flow agreement to Sept 1, 2010 and this new LOA goes above and beyond what the company had to do for any of the parties. Some will argue that 108 is not fair, but it must have been fair enough for all parties to agree to it. The 108 is imho a lot more than I expected out of this agreement.

I think PBS does not allow you to be awarded that trip. It does know if you have vacation, training etc. that will conflict with a trip award.

I forget the answer and could not find it in the contract.

If you have one week of vacation, how many reserve off days do you bid for in a 31 calendar month? I thought nine but don't know if that's right.

4. Upon implementation of PBS reserve bidding, when a reserve pilot is scheduled for a
known period of absence in the upcoming bid period, his X-days will be pro-rated for the
absence under the chart in Section 12 N. 7. His reserve guarantee will be reduced by
1/30th or 1/31st for each day of the absence, and he will be paid the value of the absence
in addition to any other pay for the bid period. Assume a 30-day bid period, with ALV =
75:00 and a reserve guarantee of 70:00 hours in the examples below.
a. Example 1 – Pilot has seven days of vacation in the bid period.
Results:
1) Pilot receives nine X-days.
2) Pilot’s reserve guarantee is reduced by 1/30th for each day of his vacation (70:00 –
[7 x 2:20]) = 53:40 adjusted reserve guarantee for the bid period.
3) Pilot is paid 7 x 3:00 = 21:00 for the vacation in addition to any other pay for the
bid period.

Quick question. I checked my schedule at 1500 and nothing on it, they just called and gave me a short call at 5:30am, is that legal?

FWIW, the new LOA states all CPS pilots on the list before Aug 19,2010 will have the right to flow. That is 409 pilots.
