I'm told by my rep that it is NOT legal.

He also went on to say that ALPA legal is in no mood to shut down the company directive. Said that without their support "I'd just be ****ing in the wind".

I told him to be a big boy and **** away.

Be careful out there folks. Us line swine are tinkering with a carefully crafted relationship that DAL has come to depend on.

Can you say Workplace Harassment?

No dog in this fight MadDog, but it starts getting gray when you are on the company's property, during time when you are being paid by the company or using company supplied materials (electrons / paper / mailboxes / etc.).

I believe there was a case that went in favor of LABOR when it came to using company email accounts to organize on the employee's own time, but don't quote me on that one.

You might want to contact the National Mediation Board rather than the National Labor Relations Board. The NMB is the entity which is responsible for enforcement of the Railway Labor Act. The NLRB has no jurisdiction over our industry.

This activity, if indeed the company is doing this through the CP office, would seem to be a ULP, Unfair Labor Practice. The company cannot dictate to members of unions and interfere in union affairs. It also sounds suspiciously close to being activity which could be defined as what a company union would do. A company union is also illegal. What that means is that the company cannot create a union. Interesting stuff. I am sure that there is some case law about this kind of activity.

risk having the authorities kick in your door in the dead of night?.....And potentially not only lose your job...but then be held economically liable for damages by interfering with deltas contractual labor affairs?........or.....

a piece of paper and a stamp.

IDK.....its a tough choice.

Or you could be like the guy that complained to senior flt ops management about procedures and standardization....than received 6 line checks in a 1 year period. It was all random, according to flt ops

It is NOT legal. When ALPA national tried to break the Union of its own in-house clerical workers, ALPA was quickly slapped down by a judge for unfair labor practices. There are now bulletins in the break rooms at ALPA headquarters explaining the judge's order and that ALPA has no right whatsoever to interfere in the employees internal union activities.

No way management would do this. It's flat out illegal, with court precedent against any interference in the internal politics of a union. It would be a PR disaster for them.

Would the following be an illegal action if I received this from management in response to a request to collect signatures in the pilot lounges?

"We don’t allow political activities in the lounges. I’ve had to address this with other people in the recent past. I respect your right to pursue whatever agenda you might want, and I understand there are actions outlined in the bylaws some are interested in exercising. You will have to collect signatures elsewhere."
