Sounds to me like XJT either took the loans only, or there’s a technicality on “furloughing” pilots who haven’t hit the line yet, or they furloughed before agreeing to take the CARES money.

Based on everything I understand and been reading the DOT made part of the grant a loan so than its fair game to furlough 10% and get the grant. The bigger question is not the 112 trainees let go, its the downgrades. That was a big no-no for grant money, unless they are still getting paid as CA. Which honestly I dont know enough about that situation other than 80+ CAs were downgraded to tell you what they are doing.

From what I’ve read, only one senator said anything about downgrades being a no-no. United is currently running a massive displacement, entire WB bases are being eliminated, and tons of people are going to lose their captain seat. The contract wasn’t amended, so the rates are still the same. Being the only ones making a stink are employees, I’d say that it’s legal. Sketchy, but legal.

To add to this comment, if it were possible to furlough 10% UAL would have done it, in my opinion. There was a UAL MEC email that made it very clear that they took both grant and loan. The grant language overrules the loan language. That’s why there are no furloughs at UAL. I still believe XJT furloughed trainees and considers that an exception to the guidelines. OR.....they only took the loan.

The story was in one of these furlough threads. A senator from MO wrote United a letter saying that he didn’t think that they were following the intent of the grant restrictions. After that they issued the pilot displacements and cut hours for other employees. It looks to me like United feels confident about their position. Our big displacement is effective June 30.
